PARTICIPANT WAIVER, RELEASE OF LIABILITY & ARBITRATION AGREEMENT. PLEASE READ CAREFULLY — THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
By completing this waiver, checking the agreement box, and electronically signing below, you agree to the following terms:
1. PARTICIPANT IDENTIFICATION REQUIREMENT
• One adult (18 years or older) per waiver is required.
• Each adult participant must complete their own waiver.
• Participants must present their waiver email confirmation at the admission window upon arrival.
By submitting this form, you certify that all information provided is accurate.
2. ASSUMPTION OF RISK
Roller skating and related recreational activities involve inherent risks including, but not limited to:
• Falls
• Collisions with other skaters
• Contact with fixed objects
• Equipment malfunction
• Surface hazards
• Negligent acts of other participants
• Injuries associated with alcohol consumption
Injuries may include sprains, fractures, head injuries, paralysis, serious bodily injury, or death.
By participating, you voluntarily assume all inherent and ordinary risks associated with skating and presence on the premises.
3. RELEASE OF LIABILITY
To the fullest extent permitted by California law, you release and discharge:
RollHaus Social, Wild Ember Threads LLC, and their respective owners,
members, managers, officers, employees, agents, contractors, affiliates,
landlords, successors, and insurers (collectively, the “Released Parties”)
from any and all claims arising out of or related to ordinary negligence connected with participation in activities or presence on the premises.
This release does NOT apply to gross negligence, reckless conduct, or willful misconduct.
4. ALCOHOL RESPONSIBILITY
RollHaus Social serves beer and wine pursuant to California law.
You acknowledge that:
• Alcohol impairs coordination, judgment, and reaction time.
• You are solely responsible for your decision to consume alcohol.
• You agree not to participate in skating or physical activity while impaired.
• You assume all risks arising from voluntary alcohol consumption.
5. AGREEMENT NOT TO SUE
You agree not to bring legal claims against the Released Parties for matters covered by this Agreement.
6. INDEMNIFICATION
You agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses arising from your conduct while on the premises.
7. BINDING ARBITRATION
Any dispute, claim, or controversy arising out of participation or presence at RollHaus Social shall be resolved exclusively through binding arbitration under the Federal
Arbitration Act and California law.
Arbitration shall occur in San Bernardino County, California.
The arbitrator shall have exclusive authority to resolve disputes regarding the enforceability of this Agreement.
8. WAIVER OF JURY TRIAL
By agreeing to arbitration, you knowingly and voluntarily waive your right to a jury trial.
9. CLASS ACTION WAIVER
All claims must be brought solely in an individual capacity.
You waive the right to participate in any class, collective, representative, or mass action against the Released Parties.
10. VENUE & GOVERNING LAW
California law governs this Agreement.
If any matter is found not subject to arbitration, exclusive venue shall be in San Bernardino County, California.
11. ONE-YEAR LIMITATION PERIOD
Any claim must be filed within one (1) year of the date of the incident.
Failure to do so permanently bars the claim.
12. MEDIA RELEASE
You grant RollHaus Social and Wild Ember Threads LLC permission to photograph, record, and use your image, likeness, and voice for marketing and promotional purposes without compensation.
You waive any right to inspect or approve such use.
13. SURVEILLANCE NOTICE
For safety and security, the premises are monitored by video surveillance.
By entering the property, you consent to recording.
14. PROTECTIVE GEAR ACKNOWLEDGMENT
Protective equipment such as helmets, wrist guards, elbow pads, and knee pads is strongly recommended.
You voluntarily assume all risks associated with choosing not to wear protective equipment unless required for a specific session.
15. MINOR PARTICIPANTS (UNDER 18)
If signing for a minor, you certify that:
• You are the parent or legal guardian of the minor.
• You consent to the minor’s participation.
• You agree to RELEASE AND DISCHARGE the Released Parties from liability arising from the minor’s participation, to the fullest extent permitted by California law.
• You agree to indemnify and hold harmless the Released Parties from claims brought on behalf of the minor.
Minor Participant Information Required:
• Child’s Full Legal Name
• Child’s Date of Birth
16. MEDICAL AUTHORIZATION
You authorize emergency medical treatment if necessary and accept financial responsibility.
17. ELECTRONIC SIGNATURE CONSENT
By checking the agreement box and typing your full legal name, you certify that:
• You have read and understand this Agreement.
• You are at least 18 years old, or the legal parent/guardian of a minor listed.
• You agree to be legally bound by its terms.
• Your electronic signature constitutes a legally binding signature under California law.
